Order No. 3 Dt. 20.10.14

Ld. Advocates for the Revisionist and the OP No.1 are present.

OP No -1 files vakalatnama in favour of Mr. S.K. Das, Ld. Advocate who is present. OP No.2 is absent.

The revision is taken up for hearing. Ld. Advocate appearing for the revisionist submits that, in fact, in the complaint case, it has been named as Proforma OP. But, still there is much a thing to be said by this revisionist in the said complaint case and to fight out the same by way of contest and opportunity to be given to file W.V. and to contest the case upon adjudication of the points before the Ld. District Forum, South 24 Parganas. This revision arises as neither its show cause nor the W.V. has been accepted by the Ld. District Forum. Accordingly, it is the prayer of the revisionist to allow the revision so as to enable the revisionist to contest the case before the said Ld. District Forum.

Ld. Advocate for the OP No. 1 candidly makes out that the case before the Ld. District Forum has been lingering for no fault of his and being bereft of the necessary Gas Connection which is a basic amenity of life and living. He also makes out that the revisionist , although given much opportunity by the Ld. District Forum, South 24 Parganas did not file W.V. in time, which resulted in the present impugned order.

Considering all the aspects in the matter, and the fair prayer of the revisionist to enable to contest the case, the instant prayer in the revision stands allowed for the ends of justice only. Accordingly, the revision is allowed . The impugned order is hereby set aside.
