ORDER

After some arguments, both the counsel for the parties submits that in order to cut short further delay in the matter, orders of the foras below be set aside and the matter be remanded back to the District Forum with the direction that District Forum shall take the written statement of the opposite party on record and thereafter decide the consumer complaint after giving an opportunity to lead evidence to both the parties.

            In view of the facts and circumstances of the case and the concession given at the Bar, we allow the revision petition and set aside the ex parte order of the District Forum as also the order of the State Commission.  Matter is remanded to the District Forum for disposal of the complaint on merits.  We direct that petitioner / opposite party shall file its written statement in response to the consumer complaint within six weeks from today and the District Forum shall dispose of the consumer complaint on merits after taking into account all the legal and factual pleas taken in the written statement.  Since the matter has been considerably delayed,  we request the District Forum to make an endeavor to dispose of the complaint expeditiously but not later than six months.

Parties to appear before the District Forum on 05.02.2015.  The amount deposited with the District Forum as a condition for stay shall remain deposited and it shall be subject to the outcome of the consumer complaint.  Revision petition is disposed of accordingly.
