We agree with the view taken by the State Commission. Petitioner is liable to refund the expenditure incurred on the stamp duty, as the same had been incurred by the respondent after the allotment of the plot and for the execution of the sale deed of the plot, possession of which was never handed over to him by the petitioner. Dismissed.
