                                                ORDER

 

(Per-Mr. S. D. MADAKE, Hon’ble President

 

1.       The complainant filed complaint against Seven Seas Airport and Seaport Management  India Pvt. Ltd. For deficiency in service as per sec.12 of Consumer Protection Act.1986.

2.       According to Complainant, he applied for job relying on the e-mail dated 18.04.2015 through shine com. The Complainant was assured by opponent that, he will get Rs. 35,000/- payment for eight hours duty.

3.       The Complainant was interviewed on 24.4.2015 by Mr. Rahul  . He was directed to pay Rs. 6,250/- for medical checkup Rs. 26,068/- for domestic cruise. The duty was to commence within go to 100 days.

4.       The Complainant produced on record payment receipt dated 08.05.2015 to the amount of Rs. 26,068/- by D.D. He paid Rs. 6,250/- for medical examination to UMA Hospital as suggested by opponent.

5.       According to Complainant, Opponent failed to perform the promise within the prescribed period of time. He was subjected to mental agony due to threatening by persons belonging to Opponent.

6.       The Complainant prayed for direction to Opponent to refund the amount to Complainant and Compensation.

7.       The notice was duly served to opponent. The forum passed order to proceed ex-parte against Opponent today on 06.04.2017.

8.       The Complainant filed pursis stating that the complainant and documents annexed with it may be treated as affidavit of evidence written argument and oral argument.

9.       We have perused  all the documents filed on record. The documents make it clear that Complainant was assured to get job and was also selected for the job after successful interview taken by Rahul belonging to interview.

10.     The Complainant submitted that he paid amount of Rs. 32,000/- relying on the assurance given by Opposite party.

11.     The Opponent was under an obligation to assist Complainant for getting job as assured by Opponent   . The Opponent failed to do so within a reasonable time. This is an unfair trade practice.

12.     We hold that Opponent is liable to refund the amount accepted from Complainant, under the pretext of providing him job. The Complainant is entitle to get reasonable compensation of Rs. 7,000/- for mental agony and cost.

13.     The Complainant was required to pay Rs.200/- at the time of interview , Rs.100/- for fixing appointment of hospital Rs. 6250/- for medical  exam  form a hospital as directed by Opponent .We hold that Complainant is entitle for getting the above said amounts from  Opponent as he spent the same , as per direction of opponent.

14.     In the result, We pass the following order. 

                                      ORDER

1.       Consumer Complaint No. 15/2017 is partly allowed.

2.       The Opponent Sevenseas Airport& Seaport Management Services

           India Pvt. Ltd. Is directed to pay Rs. 32,758/- with interest at 18%

           p. a. from date of filling Complaint till payment .

3.       The Opponent is directed to pay Rs. 7,000/- for mental agony and Rs.

           3,000/- as cost of complaint to Complainant.   

4.       The Opponent  shall pay the amount within 30 days from the date of

           receipt of order.

  1.         Copy of this order be sent to the both parties.
