This order shall dispose of both the RP No. 1974/2010 and RP No. 1975/2010. The State Commission has dismissed the appeals on the ground of limitation as there was delay of 46 days in filing the appeal. Limited notice was issued to the respondent to show cause as to why the impugned order not set aside and the case be remitted back to the State Commission to decide the appeals afresh on merits after condoning the delay. Heard the counsel for the parties who pleads that the case be remanded back to State Commission to decide the appeal on merits after condoning the delay. Delay in filing the appeal is condoned. Case is remitted back to the State Commission for deciding the same on merits in accordance with law after affording due opportunity to both the parties. Parties and counsel are directed to appear before the State Commission on 02.11.2010.
