The case  of the complainant is that,  
 
The father of the complainant had availed agricultural loan from the opposite parties on 30.03.2000.  The Government of Kerala has declared a “Navakeraleeyam Kudissika Nivaranam 2018”  scheme for the default loans under Co-Operative Sector.  The opposite party bank has published a notice offering various deductions in the default loan accounts.
 
The complainant's father died on 30/06/2011.  The first opposite party issued a notice offering discount to the complainant because his father being a defaulter in the loan account.  The first opposite party directed the complainant     to      attend     the     meeting     scheduled     on      16/03/2018.

The complainant attended the meeting and expressed his willingness to remit the loan amount after deducting the discount amount.  But after that the opposite  parties have wriggled out of the terms in the notice that is served to the complainant.  Hence the complainant filed this petition against the opposite parties alleging unfair trade practice and deficiency in service.  Notice served to the opposite parties.  Opposite parties have appeared before this Forum.  But they did not file version or adduce any evidence.  
 
The point for consideration is whether there was any deficiency in service from the part of the opposite parties, and if so, for what relief the complainant is entitled for?
 
The complainant adduced evidence by way of chief affidavit.  He has produced 3 documents.  Ext.P1 is the copy of death certificate, Ext.P2 is the copy of statement of accounts issued by the opposite party on 27/03/2018 and Ext.P3 is the copy of notice of “Navakeraleeyam Kudissika Nivaranam 2018” scheme for the loans under Co-Operative Sector, were marked.
 
The Point: The complainant alleges that, the opposite parties agreed that, offering discount on loan under the scheme of “Navakeraleeyam Kudissika Nivaranam.  The opposite parties  also informed the complainant that, he is entitled for a major benefit in this, since the borrower is no more.  Documents produced before this Forum.  Notice served to the opposite parties.  They have appeared before this Forum, but they did not file version or adduce any evidence.  So the opposite parties set ex-parte.
 
Hence the petition allowed.  The Forum directs the opposite parties to grant discount in the loan account of Govindan Sasi and to accept the balance amount in the loan account within 30 days of the receipt of the copy of this order.
