MA NO. 213 OF 2012 :-

          Opposite Party No.1 has moved this application for a direction to the complainant to find out the genuineness of the letter dated 12.03.2012 and to allow the opposite parties to release the payment as per the surrender and dismiss the complaint as all the issues arising in the complaint stand settled.  Reply stands filed. 

Learned counsel for the complainant under instructions states that the complainant has no objection to the surrender/payout of the policy being paid to him as he is in dire need of money but submits that this will not settle the entire claim of the complainant in the present complaint.  He is prepared to accept the said amount without prejudice to the pleas and contentions raised in the complaint.

Mr. Rakesh Malhotra, learned counsel for the opposite parties, states that the amount of Rs.95.60 Lakhs shall be paid to the complainant without prejudice to the pleas and contentions raised by the opposite parties in their written version.

The application is, accordingly, disposed of with a direction to the opposite party no.1 to pay the surrender payout of Rs.95.60 Lakhs to the complainant as early as it may be practicable but not later than ten days from the date of this order without prejudice to the contentions and pleas raised by the parties in the complaint.
