ORDER

In the instant case as per the complainant he  lodged medical insurance claim with the OP No.2 on 8.8.2018 alongwith duly filled form. But the OPs time again sought documents from the complainant, which were duly deposited by the complainant with the OPs on 20.9.2018. It is alleged that  despite completing all the formalities the OPs still did not settle the claim of the complainant.

We are of the view that once the complainant has lodged his claim and completed all the formalities, the Insurance company is bound to decide the same as per guidelines of the IRDA. Therefore,  without prolonging the issue we direct the OPs to decide the claim of the complainant within 30 days from the date of receipt of certified copy of this order as per guidelines of the IRDA, failing which they shall be liable to pay cost of Rs.5000/- to the complainant. In case the complainant is not satisfied with the decision of the OPs insurance company he shall have the liberty  to approach the appropriate Forum for redressal of his grievance under the provision of law.  Accordingly the complaint disposed off.

Certified copy be sent to the parties free of charge. After compliance file be consigned.
