Appellant  and  advocate  both  have remained  absent today  at the time of  physical hearing.  Mr. Agnihotri, advocate  is present for the  respondent  and has submitted that  till today  the  respondent  has not be supplied  copy  of  application as well as appeal compilation.  Record  also shows that  till today  the appellant  has never  complied with the order  nor  supplied   the copy of application to the respondent  and has also remained  absent.  It appears  that the applicant  is not serious in pursuing  an application and  so no further  time can be granted to the applicant. Application for condonation of delay is hereby dismissed  in default. Consequently  the appeal does  not survive and is disposed  off.
