ORDER

We have heard the Learned Counsel for the Petitioners and perused the impugned order dated 29.11.2017, passed by the West Bengal State Consumer Disputes Redressal Commission at Kolkata (hereinafter referred to as the State Commission), whereby the Appeal, preferred by the Petitioners, has been dismissed for non-prosecution as on 29.11.2017, nobody appeared on their behalf.

Service of notice on the Respondent has been effected but nobody has appeared on his behalf.

The Learned Counsel for the Petitioners submitted that on account of some communication gap, the Counsel could not appear before the State Commission on the date fixed and, therefore, the Appeal was dismissed for non-prosecution.  The Petitioners shall appear before the State Commission on the next date and shall not seek any unnecessary adjournment if the impugned order is set aside.

We accordingly allow the Revision Petition; set aside the impugned order dated 29.11.2017; and direct the Petitioners to appear before the State Commission on 04.02.2019 for further proceedings.  We also request the State Commission to decide the Appeal expeditiously in accordance with law, preferably within a period of three months from the date of appearance by the parties before it, i.e. 04.02.2019.
