Taken up through video conferencing.

1.       Learned counsel for the appellant builder co. submits that a joint application, being I.A. No. 5025 of 2021, has been filed by the appellant builder co. and the respondent complainant seeking withdrawal of the present first appeal as a consequence of a settlement.

2.       No comments of this Commission on the contents and ingredients of the settlement arrived at. 

3.       In the wake of the above submission, and in the light of the said I.A. No. 5025 of 2021, this first appeal is rendered infructuous.

4.       The first appeal no. 888 of 2016 is dismissed as such.

The appellant builder co. shall not have the option to revive its appeal before this Commission.

5.       The Registry is requested to send a copy each of this Order to all parties in the appeal and to their learned counsel within three days. The stenographer is requested to upload this Order on the website of this Commission immediately.
