Revision Petitioners are the opposite parties in CC.147/16 on the file of Consumer Disputes Redressal Forum, Palakkad. The order passed by the Forum in an interlocutory application, I.A.412/16, in the above complaint over restoring of the back up power supplied to the generator attached to a multi storied building, with some directions, is challenged in this revision by the opposite parties.
2. When the revision was taken up for hearing there was no representation for the revision petitioners and also the respondents. Perusing the memorandum of revision and also the Order passed by the lower forum we find that imputing deficiency of service a number of flat owners together filed the complaint before the forum, in which later they moved an interlocutory application they complaining that after filing of the complaint the builder disconnected the back up generator power supply for the lift installed. Notice given to the opposite parties the builder filing a counter contended that there was default on the part of the flat owners, complainants, to pay the fuel charges and other incidental expenses for operating the generator. The forum appreciating the materials produced passed the impugned order directing the opposite parties to restore the back up power supply to the generator on payment of a portion of the cost of fuel by the complainants. That order is challenged in the revision. We do not find any impropriety or illegality in the order passed by the forum on the facts presented in the case. There is no merit in the revision, and it is dismissed.
