ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:
JUDGMENT
Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 seeking following relief;
“Direct the opposite parties not to disturb the value and peaceful possession of the complainant on the lease land bearing Plot No.898 under Khata No.610, Area A.1.330 dec., Mouza Sarapada and pay Rs.5,00,000/- towards cost of the grown up fishes in the tank taken under lease, Rs.2,00,000/- towards cost of harassment and mental agony, Rs.1,13,000/- towards cost of money deposited for lease land and Rs.50,000/- towards cost of litigation.”
Opposite parties No.1 & 2 has filed their objection.
The complainant lease/licensee holder granted by opposite parties. The consideration paid in lease/license from Govt./Public Representative cannot be termed as consumer as defined U/s.2(7) of Consumer Protection Act. Hence the consumer complaint is not maintainable and accordingly the consumer complaint is dismissed. No cost.
