          By filing this appeal, BPTP Limited-Builder has challenged the order dated December 22nd, 2014 of District Consumer Disputes Redressal Forum, Gurgaon, whereby, it directed to pay Rs.4,53,911/- alongwith interest at the rate of 18% per annum, that is, amount paid by Sanjeev Sharma-complainant at the time of booking of the flat; Rs.20,000/- as compensation and Rs.5000/- litigation expenses, to the complainant.

2.      Sanjeev Sharma-complainant alongwith his counsel Sh. S.S. Pattar has stated that he is satisfied in case the Builder pays him the amount of Rs.4,53,911/- deposited by him and does not claim the interest, compensation and litigation expenses etc.

3.      Learned counsel for the Builder has paid the amount of Rs.4,53,911/- to the complainant through cheque vide Annexure A-1. 

4.      In view of the above, the impugned order is set aside qua the compensation, interest and litigation expenses awarded by the District Forum. 

5.      The appeal stands disposed of accordingly.

6.      The statutory amount of Rs.25,000/- deposited at the time of filing the appeal be refunded to the appellant against proper receipt and identification in accordance with rules, after the expiry of period of appeal/revision, if any.
