Complainant absent. On perusal of the ordersheet it reveals that despite sufficient opportunity and for the reasons best known to the complainant who remained absent and did not come forward to file his affidavit evidence. Merely on basis of pleadings the case of the complainant cannot be appreciated, pleadings are not the substitute for evidence. The complainant has to prove his case by tendering oral evidence or by affidavit evidence. The non-filing of the affidavit evidence and it shows that complainant is not interested in prosecuting the case.  Under the circumstances, the complaint is dismissed for want of prosecution.
