The case has been called out for hearing the second time.  Mr.Ashutosh Mishra, Advocate, who has put in appearance on behalf of Mr.Tanay Ayde, counsel for the petitioner, prays for adjournment on the ground that he has received an E-mail from Mr.Ayde to pray for adjournment.

          Mr.Satish Mishra, father of the respondent/complainant is present in person and states that he had received a telephone call in the morning from Mr.Ayde informing him that he would not be able to attend to the case, as he is pre-occupied before the State Commission.

          Be that as it may, since counsel for the petitioner had not appeared even yesterday, when the case was called out for hearing twice, we are convinced that the Petitioner is trying to gain time to comply with the directions issued by the District Forum.  Therefore, we are not inclined to accede to the prayer for adjournment.  It is pertinent to note that even otherwise the present Revision Petition is barred by limitation by 280 days, for which no satisfactory explanation has been furnished.

          Accordingly, the Revision Petition is dismissed for non-prosecution.
