CONSUMER COMPLAINT NO. 54  OF  2023

AWARD

1.   Case taken up today as 22.04.2023 was declared public holiday under the orders of Chandigarh Administration and notice was placed on the official website & notice board of this Commission that case shall be taken up on 29.04.2023. Copy of the notice placed on the file.

2.   Vide his separate statement recorded on 12.04.2023, Sh.Devinder Kumar, Counsel for OP No.1 has stated that the matter has been settled between the parties and as per settlement, the OP No.1 shall pay a lumpsum amount of Rs.15,000/- in full and final settlement of the present matter to the complainant within a period of 25 days from the date of receipt of certified copy of the order, subject to the return of refrigerator in question alongwith its accessories. Vide his separate statement recorded on 12.04.2023, the complainant has admitted the aforesaid statement of Sh.Devinder Kumar, Counsel for OP No.1 and stated that the refrigerator in question is already lying with OP No.2. It has been further stated by the complainant that the accessories of refrigerator will be handed over to the OP No.1 at the time of receiving the aforesaid payment and prayed that the complaint be disposed off in terms of aforesaid settlement in the Upbhokta Lok Adalat.

3.   As per office report, certified copy of the order dated 12.04.2023 given by hand to the counsel for OP No.1 on 18.04.2023.

4.   In view of the above, the complaint stands disposed off by passing the following order:-

1. The OP No.1 shall pay a lumpsum amount of Rs.15,000/- to the complainant within a period of 25 days from 18.04.2023, i.e. the date certified copy of order dated 12.04.2023 was given to the counsel for OP No.1.
2. In case OP No.1 fails to pay the aforesaid amount within the stipulated period, then OP No.1 shall be liable to pay the aforesaid amount alongwith interest @ 9% p.a. from the date of filing of present consumer complaint     i.e. 02.02.2023 till its realization.
3. The complainant shall return the accessories of refrigerator in question to OP No.1 at the time of receiving the aforesaid payment.

5.   The complaint is disposed off accordingly.

6.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
