Amit Kumar aged about 34 years son of Shri Krishan Chand, resident of Village Dingar Majra, Tehsil Gharaunda, District Karnal.

1.       Samsung India Electronics Pvt. Ltd. Registered Address: 6^th Floor, DLF Center, Sansad Marg, New Delhi 110001, through its Manager.

2.       Samsung Service Center, situated at Railway Road, near DAV School, Karnal, through its authorised signatory.

3.       J.M.D. Mobile Store, G.T. Road, Gharaunda, Tehsil Gharaunda, District Karnal, through its authorised signatory.

Complaint under Section 35 of Consumer Protection Act, 2019 as amended upto date.

Present:     Complainant in person.

                   Shri Dheeraj Sachdeva, counsel for OP No.1.

         

                   Power of attorney on behalf of OP No.1 filed. Notice issued to OPs No.2 & 3 not received back. At this stage, learned counsel for OP No.1 suffered his separate statement to the effect that the company is ready to repair the mobile phone of the complainant free of cost within one month from today on deposition of phone by the complainant to the authorised service centre of the OP No.1 within one week from today. The company is also ready to extend three months warranty as per warranty terms and condtions.

                   On the other hand, complainant appeared and suffered his separate statement to the effect that the matter has been compromised with the OP/company and the OP/company is ready to repair his mobile phone free of cost. Hence, in view of the statement of learned counsel for OP No.1, he withdraws the present complaint

      In view of statement of complainant, the present complaint is dismissed as withdrawn. Both the parties shall remain bound by their statements. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
