The case of the complainant is that the complainant purchased one almirah at a price of Rs.41,562/- and the complainant paid a sum of Rs.14,603/- and the balance amount was paid by the complainant through EMI. The complainant is frequently getting from o.ps. to pay Rs.7316/- as EMI instead of Rs.3464/-. In view of the said fact the complainant filed this case praying for direction upon the o.ps. to refund the advanced money and also for other reliefs.

On perusal of the complaint it appears that the complainant purchased the almirah and the almirah is in the possession of the complainant and she paid Rs.14,603/- out of the value of Rs.41,562/-. The complainant failed to prove that she paid further EMI to o.p. no.3. Apart from the said fact the complainant prayed for return of the amount paid by her which she paid at the time of taking delivery of the said almirah. The claim made by the complainant is ambiguous and since the EMI was not paid, o.ps. claimed the EMI therefore we hold that there was no deficiency in service on the part of o.ps. Therefore we do not find any merit to issue notice against the o.ps. Accordingly, the case is dismissed in limini.
