FINAL ORDER / JUDGEMENT

Both parties filed hazira through Advocate.

The case is fixed for argument.

Heard argument on both sides.

Accordingly the Commission delivers judgement as  hereunder: -

The Complainant’s case is that he invested with the O.P. a sum of Rs.14,000/- on 18-05-2012 and Rs.21,000/- on 22-05-2012 with the return of Maturity value of both Certificates on 18-05-2018 but the Complainant was refused the Maturity value on production of Original Investment Certificates. Hence this case.

The O.P. contested the case by filing a written version contending inter alia that this Commission has no jurisdiction to pass any order of payment against the O.P. as the Apex Court imposed embargo on the property of O.P. (vide the Order dated: 21-11-2013 passed by the Apex Court in Contempt petition No.412 of 2012 arising out of Civil Appeal 9813 of 2011).

Having gone through the entire materials on record and submission and contention on both sides the Commission finds that the Complainant has not yet received the Maturity value of the above mentioned two Investment Certificates though the Maturity period has already expired as long back as on 18-05-2018.

The Complainant is a Consumer vis-à-vis the O.P. and it is an act of deficiency in service on the part of the O.P.on their failure to pay the Matured value in favour of the Complainant in time. Embargo of the Apex Court as contended by the Ld. Advocate for the O.P. shall not stand as a bar for this Commission to grant the reliefs as prayed for by the Complainant.

The Complainant is entitled to get the relief as prayed for.

 

Hence it is ordered……..

That the case be and the same is decreed on contest.

The O.P.s are directed to pay to the Complainant Rs.14,000/- and Rs.21,000/- with accrued prevailing interest thereon together with compensation of Rs.10,000/- within two months from this date in default the Complainant may recover the same in due process of law.

Both parties be supplied copy of the order free of cost.
