I am happy to note that during the pendency of this Appeal, the parties have arrived at an amicable settlement.

As per the terms of settlement, the Appellant has agreed to pay to the Respondent/Complainant interest @ 10% p.a., instead of 12% as awarded by the State Commission, and the Complainant forgoing the amount of compensation, as awarded by the State Commission. On payment of the said amount, the Complainant shall be left with no claim against the Appellant, subject matter of the Complaint, leading to the filing of the present Appeal.  Since an amount of ₹14,08,686/- has already been received by the Complainant from the Appellant in terms of order dated 10.08.2017, the Complainant shall refund the excess amount of interest of 2%, already received by him, to the Appellant within four weeks from today.

The Appeal stands disposed of in the above terms.

The statutory amount deposited at the time of filing this Appeal shall be refunded to the Appellant.
