File taken up on the application of complainant under section 38(8) of CPA, 2019 for staying the auction proceeding with respect to Gold Loan taken by complainant. It is submitted that complainant had taken a gold loan of Rs.336700/- on 10.03.2021 and he had been paying the instalment against gold loan and nothing is due against him towards the instalment. He is being harassed by OP by making illegal demand and he has received notice of auction of the Gold articles by the OP on 27.05.2023.
Heard. Application of the complainant is not maintainable at this stage and is liable to be dismissed for various reasons. Firstly in the entire application it is not mentioned that the complainant has received any notice for the auction of the gold articles on 27.05.2023. Secondly, even the complaint case has not been admitted so far as complainant had to file some document showing the gold loan scheme and these document have not been filed even up to today and thirdly, the pleadings of the complaint are too vague to the considered. Application dismissed. Put up on the date already fixed i.e. 15.07.2023.
