The matter was passed over. On the second call also there is no appearance on behalf of appellant. On the last date of hearing counsel for the appellant had prayed for time to obtain instructions as to whether there was any nexus between the alleged transaction between the Highway Authority and the complainant with the subject loan transaction. As there is no appearance on behalf of appellant since morning, under these circumstances, the present appeal stand dismissed in default.
