This revision petition was dismissed on 14.11.2007 by a Bench consisting of Mr.Justice S. N. Kapoor and Mr. B. K. Taimni, Hon’ble Members of this Commission by observing thus: None is present for the petitioner. The case was called for earlier and passed over. None is present on the second call also.
-2- The learned State Commission has allowed the appeal of the respondent and dismissed the complaint on two grounds, firstly, that as per record brought on record by the respondent, there was no electric supply between 8 am to 2 pm, hence there was no question to two cables coming into contact and resulting fire as there was no electric supply; secondly, that they have also held that the circuit breakers provided in built insularity against such an accident. We had given time to the Ld. Counsel for the petitioner to bring on record some evidence of Expert Electrical Engineer to assail the findings of the State Commission to enable us to re-consider the matter. The petitioner has not complied with the direction. In the present state of affairs, there is nothing on record for us to take a view different from the view taken by the State Commission. The revision petition is dismissed accordingly.” Petitioner has filed the review application. Counsel for the applicant/petitioner even today has not put on record any evidence of expert Electrical Engineer to assail the finding of the State Commission to enable us to reconsider the matter. The revision -3- petition was dismissed for non compliance of the direction issued by this Commission. Review can be entertained and allowed only if there is any mistake apparent on the face of order. No such mistake has been pointed out. Misc. application is dismissed. |
