Perused the complaint. Heard Adv. Of the Complainant.

It is observed that the policy issued in the name of M/s Kiran Tours & Travels but in para No. 2 of the complaint, it is avert that the vehicle is purchase in the name of the Complainant Kiran Kale/Kiran Parte from this averment it is seen that the name mentioned in the policy and Complainant name before this Commission is different.

It is averred in para No. 4.1 that, Complainant started tours and travel business under the name of style Kiran Tours & Travels and therefore the policy of said vehicle is in the name of Krian Tours & Travels.

The Complainant in her Complaint submitted that, she entered with an agreement of sale of vehicle with one Rakesh the Police registered the crime u/s 406 of IPC against the Rakesh and investigated the matter but they failed to avert the said Rakesh.

Thereafter the Complainant lodged the claim with the Op.No. 1 & 2 for loss of vehicle, but the Complainant in his Complaint no where maintioned that loss caused by the breach of trust is covered under the policy issued by Op.No. 1 & 2 and therefore, the complaint stands dismissed.
