This is a complaint filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.
2. Complainant’s case in short is that on 24.06.2021 he purchased a brand new electric kettle from the opposite party by paying Rs.1254/-. Subsequently, the complainant noticed that there was a leackage for the brand new electric kettle purchased by the complainant from the opposite party. Hence on 28.06.2021 the complainant approached the opposite party and informed about the defect in the kettle purchased from the opposite party and requested to replace the same with another piece. But the opposite party refused to accept the defective electric kettle and also refused to replace the same with another one. According to the complainant selling of a defective article as if the same is a brand new item, by the opposite party to the complainant amounts to unfair practice. Hence the complainant approached this commission for redressing his grievance.
3. After admitting the complaint, this Commission issued notice to the opposite party for appearance before this Commission on 13.08.2021 and to file version on that day. There was no sitting of the Commission on that day due to Covid 19 restrictions, the case was adjourned to 13.10.2021 by notification.
4. Meanwhile on 06.09.2021 the complainant filed a memo stating that the dispute between the complainant and the opposite party was amicably settled out of Court and hence the complainant is not willing to further proceed with this complaint.
5. In view of the settlement memo filed by the complainant, this Commission suo moto advanced this case from 13.10.2021 to 24.09.2021 and after accepting the memo the case was posted to 28.09.2021 for orders.
6. In view of the settlement memo filed by the complainant, we consider that this is a fit case to be dismissed as not pressed.
In the result, the complaint is dismissed as not pressed. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
