This is a complaint filed under Section 12 of Consumer Protection Act 1986
2. The complainant’s case in brief as follows:- The complainant had availed a loan of Rs.5,50,000/- from the Opposite Party’s bank by mortgaging his 15 cents of property on executing a gahan bearing No.1047/15 of Pulpally Sub Registrar Office. Thereafter the Complainant had closed the loan and obtained all the documents on 18.12.2017. But, the Opposite party has not executed release deed. Hence this complaint to get execution of release deed and to get Rs.10,000/-towards compensation with cost.
3. To prove the Complainant’s case, he has given evidence as PW1. Nothing improper to discredit the evidence of PW1. There is no contra evidence also. So his case is to accepted and the complaint is to be allowed.
In the result the complaint is allowed. The Opposite Party is directed to execute release deed in favour of the complainant and to pay Rs.10,000/- (Rupees Ten thousand only) towards compensation and Rs.1,000/- (Rupees One thousand only) towards litigation expenses within one month from the date of receipt of this order.
