1.       No response from the petitioner even on repeated calls.

2.       Petition has been pending since 2022.

3.       Perusal of the order sheet shows that defects have not been cured by petitioner.  Sufficient opportunity to cure the defects was granted to the petitioner time and again but despite sufficient opportunity the petitioner is not taking steps in that regard and is not pursuing the matter in right earnest.  Proceedings dated 30.12.2022 and 27.03.2023 reveal the same state.  Matter was again listed on 17.05.2023 but none appeared for the petitioner and the defects remained unaddressed.  The last proceedings dated 23.08.2023 again shows that further opportunity in that regard was given to the petitioner to cure the defects.  Today when the matter has been taken up nobody appears for the petitioner.  The office report reveals that the defects still have not been cured. 

4.       It appears to be a clear case of non-prosecution. Hence petition stands dismissed in non-prosecution.     

7.       However, in the interest of justice it may be observed that if the petitioner is interested in pursuing the matter in right earnest and feels aggrieved by this Order she may move appropriate recall/restoration application within three months from today. 

8.       The Registry is requested to send a copy each of this Order to all parties in the petition. The stenographer is requested to upload this Order on the website of this Commission immediately.
