            Parties file hazira. The case record is taken up for hearing of the amendment petition dated 08.01.2019 filed by the complainant of C.C. No. 187/2018.

            Perused the said petition and the case record. Heard both sides. Considered.

            By filing the present petition the complainant has prayed for an order of declaration in the prayer portion of the petition of complaint to the effect “the O.P. no-2 has no right to claim against the complainant for payment of parking charge @ Rs. 100/- per day as per N.E. norms for the period the vehicle is lying at the workshop of the O.P. no.-2”.

            It appears from the petition of complaint that there is no consumer disputes in between the complainant and the O.P. no.-2 and no relief has at all been prayed for against O.P. no.-2. Therefore the proposed amendment is misconceived and as such it is liable to be dismissed.

            Hence,

                        it is,

            that the petition dated 08.01.2019 filed by the complainant is dismissed on contest. M.A. No. 18/2019 is accordingly disposed of.
