Mir Singh Vs. Reliance General Insurance Co.

 

Present:           Sh. Virender Sheoran, Adv. for complainant.

                        Sh. Balbir Sharma, Adv. for OP.

 

                        File taken up today in National Lok Adalat, on joint request of counsel for the parties.

                        Ld. counsel for OP has made a statement that the present complaint has been settled between the parties as full and final settlement in Rs.3,60,000/- (Rs. Three lacs sixty thousand) subject to fulfilment of certain formalities by complainant viz. KYC From, Letter of Subrogation, Indemnity bonds, R.C. & original keys of the vehicle etc. mentioned in the statement, within fifteen days from today otherwise complainant will have to face consequences. After receipt of the documents, OP-company will pay the agreed amount to complainant within 45 days. In case of default in making such payment within prescribed period, OP shall liable to pay 12% interest on the aforesaid amount.

                        On the other hand, learned counsel for complainant also got recorded his statement admitting the aforesaid settlement and prayed for disposal of the complaint accordingly.

                        In view of the above statements, the complaint stands disposed of being compromised as full and final settlement. The parties to the complaint are directed to remain bound by their statements made today before this Commission.  File after due compliance be consigned to record room. Certified copies of this order be supplied to the parties concerned, free of costs, as per rules.  File after due compliance be consigned to the record room.
