JUDGMENT
Complainant has filed the consumer complaint U/s.35 of C.P. Act, 2019 seeking a direction for death benefits of Group Janata Personal Accident Insurance Policy bearing No.100300/47/01/9600022 covering the period from 15.4.2004 to 15.4.2019.
Notice to opposite party was sent on 11.4.2022 by Regd. Post from this Commission but opposite party though appeared but did not file any written version and ultimately set ex-parte on 15.02.2024.
Both parties are absent repeatedly on most of the date except a few dates. We have gone through the consumer complaint but did not find any ward whether the death is natural or accidental. The very word of policy is Group Janata Personal accident Insurance Policy but we are in dark whether death is accidental or natural.
We therefore direct the complainant to submit her claim within one month along with all documents which are required for settlement of claim, if the claim comes within the scope of the policy then payment shall be made within 60 days after submission of policy by the opposite party. For non responding to the letters of complainant, non filing of written version and keeping this Commission in dark, we impose cost of Rs.2,000/- to be paid to complainant by the opposite party. With the aforesaid observation and direction the consumer complaint is disposed of.
