It is stated by the parties counsel that the parties have amicably settled the subject matter of the present complaint.  Mr. A. Prasad, Sr. Executive Officer under authority and instructions of the opposite party-hospital states that the opposite party is ready to pay a sum of Rs.2,00,000/- (Rupees Two Lakhs only) to the complainant as ex-gratia amount, if the complainant is prepared to withdraw all the allegations of medical negligence and deficiency in service made by him in the complaint.  The complainant is also present in person and states that the offer is acceptable to him.  Separate statements of the complainant-in-person and Mr. A. Prasad, Sr. Executive Officer of the opposite party-hospital have been recorded to this effect.

            In view of the settlement reached between the parties, the complaint is dismissed as withdrawn.  The opposite party-hospital shall pay a sum of Rs.2,00,000/- (Rupees Two Lakhs only) to complainant Paras Nath Bajpai by means of a demand draft within a period of two weeks from today.  No order as to costs in these proceedings.
