PER:- S.P, SOOD, PRESIDINGMEMBER:

                    File taken up today before the National Lok Adalat.

2.                Mr. Vivek Aggarwal, learned counsel for the Decree Holder-complainant has suffered a statement on 03^rd February, 2023 that he has received seven cheques bearing Nos. 834465 dated 05.02.2023 834466 dated 06.03.2023, 834468 dated 07.04.2023, 834469 dated 08.05.2023, 834470 dated 09.06.2023, 834471 dated 10.07.2023 and 834472 dated 15.08.2023 each amounting to Rs.7,10,000/- Total amounting to Rs.49,70,000/- (Total amounting to Rs. Fourty nine lacs seventy thousand only) of Indian Overseas Bank issuing in favour of Mr. Varun Gupta, Decree Holder-complainant from Judgment Debtors-opposite parties as full and final payment in view of memorandum of settlement dated 27.01.2023. His statement in this regard recorded separately.

3.                On the other hand, Mr. Sumesh Mahajan, proxy counsel for Mr. Manjinder Kumar, counsel Judgment Debtors-opposite parties has placed on record memorandum of settlement dated 27.01.2023 along with photocopies of the abovementioned cheques.

4.                In view of the above-mentioned development made by learned counsel for both the parties, the present execution application stands dismissed as withdrawn being settled.

5.                Let, original documents be returned to the parties after getting photocopies of that documents from them against proper receipt and as per rules, after noting down in the registered, if maintained.

6.                Application(s), pending, if any, stand disposed off accordingly in terms of this order.

7.                File be consigned to record room alongwith a copy of this order.
