Counsel for parties are present. The case was dismissed in default vide order dated 03.08.2012 which runs as follows: he case is called out at 12.30 p.m. also but none appeared on behalf of appellant. Ms. Meena Mahajan, Counsel for the respondent is present. The appeal is dismissed in default for the appellant It is argued that on 03.08.2012, two cases were fixed. In one case the counsel for the petitioner appeared but in other case, he deliberately did not appear and allowed the case to be dismissed in default. On the other hand counsel for the petitioner submits that his clerk did not appear and, therefore, case was dismissed in default. He however, submits that his clerk appeared in one case and did not appear in another case. In the interest of justice, revision petition is restored subject to payment of Rs.5000/- as cost to be deposited in Consumer Legal Aid Account NCDRC of this Commission. Parties are directed to appear before the State Commission on 13.12.2012 and after satisfying that the cost has been paid shall hear the parties on merits and will decide the case expeditiously within a period of three months from 13.112.2012 onwards.
