MR. JUSTICE A. H. KHAN, PRESIDENT (ORAL)
This is an appeal filed under Section-15 of the Consumer Protection Act 1986 against the judgment and order dated 16-09-2016 passed by District Consumer Forum, Mainpuri in Complaint Case No.55 of 2016 Ram Nath Verma V/s United India Insurance Company Limited and two others.
Vide impugned judgment and order the District Consumer Forum has allowed complaint partially and passed following order.

को आदेशित किया जाता है कि वह परिवादी दिनांक 04.04.2016 से दिनांक 05.08.2016 तक की अवधि का रू0 30,000/- की धनराशि पर 09 प्रतिशत वार्षिक का ब्याज अदा करे इसके साथ साथ मानसिक कष्ट के मद में रू0 7,000/- (सात हजार रू0) तथा वाद व्यय के मद में रू0 3,000/- (तीन हजार रू0) अदा करे।
विपक्षी संख्या-2 व 3 को आदेशित किया जाता है कि वह परिवादी को दिनांक 08.05.2013 से दिनांक 04.04.2016 तक की अवधि का रू0 30,000/- की धनराशि पर 09 प्रतिशत वार्षिक ब्याज अदा करे। इसके साथ-साथ मानसिक कष्ट के मद में रू0 7,000/- (सात हजार रू0) तथा वाद व्यय के मद में रू0 3,000/- (तीन हजार रू0) अदा करे।
विपक्षी संख्या—2 व 3 को यह अधिकार होगा कि वह इस प्रकरण में दोषी अधिकारी/कर्मचारी के वेतन से आदेशित धनराशि वसूल ले क्योंकि इस प्रकरण में राम नाथ वर्मा के नाम से जारी उक्त चेक की धनराशि का अंतरण राम नाथ शर्मा के खाते में किया। इसके अतिरिक्त भी स्पष्ट है कि किस कारण, किस कर्मचारी ने बीमा कम्पनी द्वारा परिवादी राम नाथ वर्मा को प्रेषित पंजीकृत डाक जो वनहार डाक खाना छाछा तहसील भोगांव जिला मैनपुरी को न पहुँचा कर राम नाथ शर्मा ग्राम तिसौली सुल्तानगंज को प्राप्त कराया, जिससे विभाग की प्रतिष्ठा को क्षति पहुँची है।
Feeling aggrieved with the judgment and order passed by District Consumer Forum, opposite parties no. 2 and 3 of complaint have filed this appeal.
None appeared for the appellants at the time of hearing of appeal.
None appeared for respondent no.1.

Sri Anchal Mishra, learned Counsel for the respondent no.2 appeared at the time of hearing of appeal.
I have heard learned Counsel for the respondent no.2 and perused impugned judgment and order as well as records.
Respondent no.2 who is opposite party no.01 of complaint has not filed appeal against impugned judgment and order. Learned Counsel for the respondent No.2 has submitted that respondent No.2 has complied judgment and order passed by District Consumer Forum against it.
Admittedly respondent no.2 United India Insurance Company Limited sent a cheque of Rs.30,000/- to the respondent/complainant Ram Nath Verma on 21-03-2013 through post office but the cheque was delivered to one Ram Nath Sharma who encashed the cheque.
Admittedly Post Office of appellants/opposite parties has paid Rs.30,000/- to respondent No.2 through cheque dated 04-04-2016 after filing of complaint and has accepted its fault.Respondent No.2 had sent cheque to respondent No.1 through Post Office. Thus respondent No.1 who is complainant is beneficiary of service of Post Office of appellants availed by respondent No.2 and he is consumer of appellants covered with Section 2(1)(d) of the Consumer Protection Act 1986.
In view of facts and circumstances of the case the District Consumer Forum has rightly ordered appellants opposite parties to pay to complainant interest and compensation alongwith cost of litigation. Appeal has no merit and is dismissed.
Parties shall bear their own costs.
Rs.10,000/- deposited by appellants under Section 15 of the Consumer Protection Act 1986 in this appeal shall be remitted to District Consumer Forum alongwith interest accrued for disposal in accordance with impugned judgment and order.
Let copy of this order be made available to the parties as per rules.
