Counsel appearing for the appellant states that respondent No.2 i.e. National Insurance Company Ltd. has paid the entire awarded amount to the complainant and under these circumstances the appellant wishes to withdraw the present appeal.
Counsel appearing for respondent No.1/complainant confirms the factum of payment having been made by respondent No.2 and therefore he has no objection, if, the appellant is granted permission to withdraw the present appeal.
The appeal is hereby dismissed as withdrawn.
Application(s) pending, if any, stand disposed of in terms of the aforesaid order.
The statutory amount of Rs.25,000/- deposited by the appellant at the time of filing the appeal be refunded to the appellant against proper receipt and identification but in accordance with rules.
