ORDER

 

The State Commission has dismissed the appeal as barred by limitation. There was delay of 38 days in filing the appeal.

          Counsel for the petitioner submits that in spite of several attempts, respondent has not been served. On the last date of hearing counsel for the petitioner stated that it was not possible to serve the respondent in ordinary way. He took time to move an application for substituted service by way of publication. Counsel for the petitioner states that in spite of several letters written by him to the petitioner, his client i.e. the petitioner has not responded to the same. He states that he has no instruction.

          Dismissed for non-prosecution.
