Final Order / Judgement

None present on behalf of any party.

A petition has been filed on behalf of o.p No.1 Rakesh Kumar O.P. No.1 of the effect that this misc. petition is not maintainable  as  per provisions of Consumer Protection Act 1986. It has been further mentioned that the  complainant      ( o.p No.1) had filed a complaint no.-06/2014  before this forum and petitioners  of this Misc. case  were  o.ps as o.p no.-3 & 4. It has been further mentioned  that the above complaint petition was  decided in favour of complainant  and D.Hr. has filed and Ex. Case No.- 06-2014 before  forum in which distress warrant  has been issued . It has prayed that this misc. petition  be dismissed. The copy of the petition has been annexed by the o.p. It has been mentioned  therein that complainant refused  to receive the copy of the same so he filed the copy of this petition.

Heard  the learned lawyer for o.p no. 1  (complainant) and perused the record.  On perusal of the  record  it transpires  that complaint no. 06/2014 was allowed on merit on 13-06-2015. It transpires that petitioners were appeared in the above complaint petition . The  petitioner  has filed this Misc. petition on the ground about his illness and he has prayed that Ex. Party  order was passed in the complaint petition no. 06-2014. It is apparent that this forum  has  decided the case on the merit and appeal will lie against the order..  This forum has no jurisdiction  to  review  its order. In the circumstances  we are of the opinion that  this Misc. petition is not maintainable,  hence dismissed. Let a  copy of this order be furnished to both the parties as per rule.
