We are happy to note that during the pendency of this Appeal, the parties have amicably settled the dispute, subject matter of the Complaint, giving rise to the present Appeal. A Settlement Agreement executed between the parties, on 07.11.2016 has been placed on record. In view of the said Settlement and as agreed between the parties, a sum of Rs.35,41,654/- stated to have been deposited by the Appellants in this Commission, in terms of our order dated 14.09.2016, shall be released by the Office to the Complainant, through Counsel, forthwith and the interest element on the said amount, if any, shall be refunded to the Appellants, along with the statutory amount of Rs.35,000/-. A Cheque in the sum of Rs.30,80,175/-, representing the balance amount due in terms of the Settlement, has been handed over to the Learned Counsel appearing for the Complainant, who points out that there is a spelling mistake in the name of the Complainant. Mr. Aditya Narain, Learned Counsel appearing for the Appellants shall ensure that a fresh cheque in the correct name is delivered to the Complainant, within three days. The parties shall remain bound by the terms of the Settlement. In view of the above, no further orders are called for in the present Appeal and the same stands disposed of with no order as to costs. |
