ORDER

HON’BLE JUSTICE SRI. K. SURENDRA MOHAN : PRESIDENT

The revision petitioner was set ex-parte for the reason that no vakalath or version had been filed on the date to which the complaint case stood posted for version.  The counsel for the revision petitioner submits that the vakalath and version have already been filed and that the revision petitioner is ready to proceed with the trial of the complaint on merits.  He seeks an opportunity to contest the complaint by putting forward his contentions.  The respondent is represented by Adv. Gopi Krishnan. 

        Having heard the respective counsel, we are of the view that it is necessary to grant an opportunity to the revision petitioner to contest the complaint on the merits.  We therefore allow this revision petition.  The order under revision is set aside.  The District Commission is directed to take up the complaint and to proceed with the trial of the complaint after giving an opportunity to the revision petitioner also to adduce evidence and to contest the matter.  An effort to complete the trial of the case expeditiously shall also be made.  The revision is allowed as above.
