This appeal has been filed against the order passed by

the District Forum, Jaipur 4^th dated 30.8.2017 whereby the claim is dismissed.

 

The contention of the appellant is that he applied for hire purchase whereas the allotment letter was issued for outright sale. Hence, the claim should have been allowed.

 

Heard the counsel for the appellant and perused the impugned judgment as well as original record of the case.

 

The contention of the appellant is that he applied vide Anx. 2 for hire purchase agreement but Anx. 4 allotment letter was issued for outright sale.

 

The respondent has submitted the form which has been submitted by the appellant which clearly reveals that he applied for outright sale and hire purchase is specifically crossed and cut but to make the case the appellant has prepared another application Anx. 2 which is not similar to that of submitted before the Housing Board wherein outright sale is tick marked with 'yes' and it has been notarized on front and back page whereas Anx. 2 submitted by the appellant is not

notarized on the front page meaning thereby incorrect document has been submitted by the appellant only to have the relief.

 

In view of the above, there is no merit in this appeal not worth admission and stands dismissed.
