This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. When the case came up for consideration on 07/07/2022 the matter was referred for settlement talk and on discussion the matter was settled on condition that the cloth material purchased by the complainant from the opposite party shall be replaced by the opposite party. Hence the matter was adjourned to 29/07/2022 for reporting settlement. On 29/07/2022 the complainant was absent and the opposite party represented that the cloth material was replaced to the complainant. As the complainant was absent the complainant was contacted over phone and the complainant confirmed that the matter is settled and he will appear before this Commission today to report settlement. When the case came up for consideration the complainant was absent and opposite party’s counsel represented. In view of the settlement confirmation given by the complainant over phone on 29/07/2022. We find that this is a fit case to be dismissed as settled.
In the result the complaint is dismissed as settled. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
