Both parties filed hazira through Advocate.

The case is fixed for argument.     

Heard argument on both sides.

The Commission proceeds to dispose of the case as hereunder: -

The complainant’s case is that they being the small farmers purchased paddy seeds from the O.P. under Cash Memo No.701, dt.23-06-2015 for Rs.560/- and Cash Memo No.713, dt.27-06-2015 for Rs.420/- and accordingly seeds were sown but the complainants got sub-standard crops as the seeds were damaged. The complainants suffered pecuniary loss for poor harvesting. The Complainant No.1 & 2 has therefore prayed for Rs.31,500/- and Rs.21,000/- from the O.P. for the same with compensation of Rs.20,000/-

The O.P. contested the case by filing written version contending inter alia that all the supplied seeds were of good quality and standard and that there is no evidence on record to prove the quality of the seeds. Hence he has prayed for dismissal of the case.

Having regard to the facts of the case and contention on both sides the Commission finds that there is proof of supply of seeds to the complainants but the quality thereof could not be verified from any acceptable proof of document. There is also no scope at this stage to test the quality of the seeds. However, considering the entire facts and circumstances and nature of the case and in absence of any basis for assessment of damaged seeds the Commission decides to direct the O.P. to pay to the complainants Rs.2,500/- each as compensation by applying the Thumb Rule.

Hence it is ordered……..

That the case is allowed in part on contest against the O.P..

The O.P. is directed to pay to both complainants Rs.2,500/- each as compensation within one month from this date in default they may realize the same in due process of law.

Both parties be supplied copy of the order free of cost.
