Heard learned counsel for the petitioner. Petitioner filed complaint before the District Forum for quashing bill raised by the opposite party. The District Forum allowed the complaint and directed to refund the amount. On appeal, the State Commission dismissed the complaint. Perusal of record reveals that bill was raised as electric meter of the complainant was running slow by 15.40%, as per the checking report dated 18.12.2000. As this matter pertains to theft of electricity, in the light of judgment passed by the Honle Apex Court in U.P Power Corporation Ltd. & Ors. Vs. Anis Ahmed case, complaint was not maintainable before the District Forum. In such circumstances, revision petition, which has been filed alongwith delay of 157 days and complaint being not maintainable before the District Forum, is dismissed with liberty to the petitioner to approach to the appropriate authority under the Indian Electricity Act for redressal of his grievance.
