1.       Case called out intermittently.  None appears from the petitioner, neither learned counsel nor the proxy counsel nor anybody else on its behalf. There is no adjournment application either.

2.       The perusal of the order-sheet shows that even on the last date, none had appeared for the petitioner. It appears to be a clear case of non-prosecution.

3.       The instant petition stands dismissed in non-prosecution as such.

4.       However, in the interest of justice, it may be observed that if the petitioner wants to pursue the matter in right earnest with due diligence, it may move appropriate application seeking recall of the Order and restoration of the instant petition in accordance with law.

5.       The Registry is requested to send a copy each of this Order to the parties in the Petition and to the learned counsel for the petitioner as well as to the fora below within three days. The stenographer is requested to upload this Order on the website of this Commission within three days.
