Case called several times since morning but none appeared on behalf of applicant till 2.00 PM which proved that he is not interested to continue with the present application.
Secondly as per Section 40 of Consumer Protection Act 2019 The District Commission shall have the power to review any of the order passed by it if there is an error apparent on the face of the record either of its own motion or on an application made by any of the parties within thirty days of such order.
This order was passed on 14.7.2020 whereas the applicant moved this application on 4.9.2020 much after the passing of thirty days of order, so this application is not within the period of limitation.
Further, on 14.7.2020 Statement of Sh. Lakhvir Singh SDO of PSPCL Sehna District Barnala recorded to the effect that the opposite parties have adjusted the amount of Rs. 1,55,870/- in the account of consumer and now Rs. 1,83,481/- is outstanding as per ledger statement till July 2020. Further, on his statement Sh. JS Mann counsel for the complainant here applicant made a statement that I have heard the above said statement of opposite parties and agree with the same and I withdraw the present complaint on behalf of complainant. Power of attorney on Jasvir Singh given to Sh. JS Mann Advocate is also on the Jasvir Singh Vs PSPCL MA 12/2020
file and he can made any statement on his behalf. We have perused these statements and in our view there is no error apparent on the face of the record. In view of these circumstances there is no merit in the present application and same is dismissed. However, no order as to costs or compensation. Copy of the order be supplied to the applicant free of costs. File be consigned to the records.
