This a complaint filed alleging deficiency of service and seeking replacement of the motor cycle with a new one or in the alternative refund of the price from the opposite parties.
- The first opposite party filed written version denying all allegations and claims made in the complaint. The second opposite party is set ex-parte.
- Today the case is posted for the affidavit of the complainant as last chance. But the complainant remained absent and there is no representation for him. The onus is on the complainant to prove the allegations. But the allegations are not proved. The complainant is continuously absent and it appears that he is not interested in pursuing the matter. The allegations are not proved.
In the result, the complaint is dismissed. No order as to costs.
