An Application being I.A. No.1820 of 2022 has been filed by the Appellant stating therein that the Matter is amicably settled between the Parties on 31.10.2021.  The First Appeal is disposed of in terms of the Settlement giving liberty to the Parties to file an Application for recall of this Order in the event any term of Settlement is not complied with.

          The name of the Appellant be substituted to Emaar India Ltd.  The Registry is directed to release the amount of Rs.45,88,561/- along with accrued interest, if any, in terms of the Settlement Agreement as also the Statutory amount of Rs.35,000/- along with accrued interest, if any, in favour of the Appellant i.e. Emaar India Ltd.
