Present:     Ms. Preeti Manderna, counsel for the appellant.

 

Vide order dated 24.01.2024, passed by this Commission; notice has been issued to respondent on application for condonoation of delay as well as in appeal as well as application for staying of impugned order. These notices are returnable for 03.07.2024. A miscellaneous application No.71 of 2024 has been filed seeking preponment of date on ground that complainant has preferred execution before the District Consumer Commission Karnal, which is listed for 20.03.2024. Learned counse has urged that: in case, the execution is enforced before the District Consumer Commission, Karnal, then  in that eventuality, the purpose of filing this appeal would become infructous. On this contention, learned counsel has urged that date fixed in case may kindly be preponed. Record refects that Rs.27,39,500/- has already been deposited by appellant in this Commisison while filing this appeal. Appellant M/s Harsha Associates Private Limited would now appear before Ld. Executing Court on 20.03.2024. In case, balance amount on the force of impugned order dated 04.08.2023 is ultimately deposited by the appellant before the District Consumer Commission, the same shall not be released to complainant, till further orders, of this Commission. M.A. No.71 of 2024, is disposed of accordingly.

          Now, matter be put for date fixed i.e. 03.07.2024.
