Learned counsel for the complainant submitted that there is no one to instruct him and it appears that complaint has become infructuous. This complaint was filed in the form of PIL, which is apparently not maintainable before the National Commission. Learned counsel for the OP also apprised that Mr. B. Srinivasa Rao, filed affidavit on 23.08.2004 along with Annexures A1 to A3 and these annexures reveal that from time to time permission has been granted by Ministry of Health and Family Welfare, Government of India. In such, circumstances, this complaint has become infructuous. Consequently, the complaint being infructuous is dismissed against the OP.
